ajiwai Terms of Use

These terms and conditions govern your use of the “ajiwai” service (hereinafter referred to as the “Service”) provided by Renospe Corporation (hereinafter referred to as the “Company”). Please use the Service upon agreeing to these Terms of Use.

Article 1 (Definitions)

Terms used in this Agreement are defined as follows
(1) Service
Services operated by the Company and related services.
(2) Website
A website on which the contents of the Service are posted.
(3) Contents
A generic term for text, sound, still images, video, software programs, code, etc. (including posted information) provided on the Service
(4) Users
All persons who use the Service.
(5) Registered Users (Hosts only)
Those who have completed user registration on the Site.
(6) ID (Hosts only)
A string of characters that a registered user uniquely possesses for the use of the Service.
(7) Password (host only)
A cipher set uniquely by the registered user corresponding to the ID
(8) Personal information
A generic term for information that can identify an individual, such as address, name, occupation, telephone number, etc.
(9) Registration information
A generic term for information registered by a registered user on the Site (excluding posted information). Intellectual property
(10) Intellectual Property: Inventions, devices, new varieties of plants, designs, works and other items produced by human creative activity (including discovered or elucidated laws or phenomena of nature that have industrial applicability), trademarks, trade names and other items indicating goods or services used in business activities, trade secrets and other items that may be used in business activities. technical or business information useful for business activities.
(11) Intellectual property rights
Patent rights, utility model rights, breeder’s rights, design rights, copyrights, trademark rights, and other rights provided for by law with respect to intellectual property or rights pertaining to legally protected interests
(12) Host
A user who uses the Service to host a home cooking experience
(13) Guest
A user who participates in a home cooking experience using the Service.

Article 2 (Agreement to these Terms of Use)

1 Users may use the Service upon agreeing to these Terms of Use.
2 A contract of use in accordance with the various provisions of these Terms of Use shall be established between the user and the Company when the user browses the Service on each medium and completes the procedures for agreeing to these Terms of Use.

Article 3 (Modification of Terms)

1 The Company may revise the Terms of Use at any time without the consent of the user, and the user agrees to accept such revisions without objection.
2 When the Company revises the Terms of Use, it will notify the user of the contents of such revision by the method prescribed by the Company.
3 The revision of the Terms of Use shall take effect from the time the Company gives notice in accordance with the preceding paragraph.
4 Users will be deemed to have agreed to the revised Terms of Service without objection at the time they use the service after the revision of the Terms of Service.

Article 4 (Our Role and Position in ajiwai)

1 The Service is intended to provide a forum and opportunity for transactions of culinary experiences between users (hereinafter referred to as “individual transactions”).
As such, we are merely providing a platform for the establishment of Cooking Experiences, and are not a party to the Cooking Experiences, and therefore do not control or supervise individual Cooking Experiences or the content or safety of the food provided therein. As such, we cannot be held responsible for any problems that may occur between guests, hosts, and other users.
2 Users shall carry out all obligations in individual transactions at their own expense and responsibility.
3 The main purpose of the cooking experience at ajiwai is for hosts and guests to visit homes, kitchen studios, etc. and interact with each other, and the provision of meals is treated as incidental to the experience.

Article 5 (Admission Procedures for Members)

1 A person who wishes to become a member of the Service (hereinafter referred to as “prospective registrant”) must agree to the Terms and Conditions and apply for membership in the prescribed manner.
2 A person who has applied for membership becomes a registered user upon our acceptance of the application and completion of the registration procedures at our company.
3 We will send notification of communication matters, advertisements, and other information to registered users by e-mail. Please understand this beforehand.
4 We reserve the right to refuse to accept an application for membership at our discretion if any one of the following conditions applies to the applicant
(1) When a prospective member applies for membership without following the method specified by us.
(2) In the event that the applicant has been previously expelled from the membership for violating these Terms of Use or any other terms of use stipulated by the Company.
(3) When we deem that the applicant has registered by wrongful means.
(4) When a prospective registrant has registered information that is not his/her own.
(5) When we deem the applicant to be inappropriate for any other reason.

Article 6 (Account Management)

1 Users shall compensate us and third parties for any damages incurred by us or third parties due to unauthorized use of registration information.
2 Although we basically undertake to change the registration information, the user shall be responsible for the content of the information, and we shall not be liable for any disadvantage or damage suffered by the user due to inaccurate or false registration information.
3. If it is discovered that registration information has been stolen or used by a third party, the user shall immediately notify the Company to that effect and comply with the Company’s instructions.
4 In order to ensure that users can use ajiwai safely and enjoyably, the Company will conduct the necessary screening based on the information entered by the applicant. If, as a result of the Company’s screening, the Company determines that any of the following applies to the applicant, the Company may not accept the registration of the applicant’s account. Even if the Company does not accept the registration of an account, the Company shall not be obligated to disclose the reason to the applicant.
(1) If there is a possibility that the applicant is not a real person. ajiwai asks all prospective hosts and guests to provide their real names.
(2) When the information provided by the applicant is suspected to be false or inaccurate. Please make sure to enter accurate information when you apply.
(3) If the applicant is unable to send or receive e-mail using the e-mail address entered by the applicant. In order for us to be able to communicate with you, the e-mail address you provide must be available.
(4) The applicant is under 18 years of age. ajiwai is only available to users who are 18 years of age or older.
(5) The applicant is already registered for another account. Users are not allowed to register more than one account.
(6) In any other case where ajiwai deems it inappropriate for the applicant to register an account.
5.If the Company accepts the registration of an account by the applicant as a result of the screening process as stipulated in the preceding paragraph, the Company shall register the information entered by the applicant, and such registration shall be deemed to be an indication of acceptance by the Company.
6 We want to provide ajiwai to our users to enhance their satisfaction, but in order to do so, it is necessary that the information you have registered is accurate and up-to-date. If you wish to change your e-mail address or other registered information, you must promptly notify ajiwai of such changes using the procedures specified by ajiwai.
7. You may close your account at any time by contacting the Company.
8. In order to protect the security of ajiwai, users are requested to observe the following
(1) Do not share your account password with any third party and do not allow any third party to access your account. (However, only if you have registered as a corporation, you may share your account under the supervision of the person responsible for registration.
(2) Not to transfer or otherwise allow others to use your account.
(3) Not to engage in any activities that may jeopardize the security of the account other than those described above.
(4) Notify us immediately if you notice any evidence that your account has been used by an unauthorized person. 9. By registering for an account, you represent and warrant that
(1) the information you provide in your application is true and correct
(2) That it is not (1)(i) a Bouryokudanin, etc., (ii) a person who may engage Bouryokudanin, etc. in its business or use Bouryokudanin, etc. as an assistant in its business, (iii) a corporation with Bouryokudanin, etc. as a director, (iv) any other person recognized as being under the influence of Bouryokudanin, etc. (2) a group that pursues economic benefits through violence, force, or fraudulent methods, a person who falls under any of the following categories: a group or individual that pursues economic benefits by making full use of violence, force or fraudulent methods, or a group or individual that commits acts against public order and morals, or their related persons (hereinafter referred to as “Anti-Social Forces”).  The applicant is not a member of any of the above groups or individuals.
(3) That you have no past or present, direct or indirect, business dealings, monetary payments, provision of benefits, or any other relationship or interaction with Anti-Social Forces.
10. If we determine that a user has violated Article 6.6 at the time of account registration, has materially breached the compliance requirements set forth in Article 6.11, or has violated any of the obligations or representations and warranties set forth in this Agreement, we may terminate the user’s account. The Company reserves the right to terminate the account of a user who has had his/her account terminated. Users whose accounts have been terminated will not be able to use ajiwai.

Article 7 (Handling of Personal Information, etc.)

Personal information and user information shall be handled appropriately in accordance with the “ajiwai Privacy Policy” separately established by the Company.

Article 8 (Prohibited Acts)

When using the Service, the Company prohibits the following acts by users. If the Company deems that a user has violated any of the prohibitions, the Company may cancel the user’s membership or take any other action that the Company deems necessary. In the event that a user violates a prohibited act, the user shall pay the Company 1,000,000 yen as a penalty.
(1) Actions that violate or may violate laws, these Terms and Conditions (including guidelines, policies, and other supplementary rules separately stipulated by the Company, the “Terms and Conditions, etc.”), or public order and morals, such as providing alcoholic beverages to minors.
(2) Any act that violates or may violate the copyrights, trademarks, or other intellectual property rights of the Company, other users, or other third parties (hereinafter referred to as “Third Parties”).
(3) Collecting personal information of other users or providing such information to a third party.
(4) Discriminating against or defaming other users, or defaming the reputation or credibility of other users
(5) Discriminatory, offensive, violent, sexual, or antisocial expressions against other users, or expressions that may induce illegal activities
(6) Actions that unreasonably offend or cause discomfort to other users, or actions that annoy or harass other users.
(7) Actions for profit, actions for sexual or obscene acts, actions for the purpose of meeting or dating an unacquainted person of the opposite sex, or other actions to use ajiwai for a purpose different from the Company’s intended use of the ajiwai site.
(8) Impersonating a third party or disseminating false or inaccurate information.
(9) Pre-election campaigning, election campaigning (including similar activities), or any activities that conflict with the Public Offices Election Law.
(10) Conducting any sales, advertising, publicity, or solicitation regarding products or services to other users.
(11) Soliciting other users to join religious activities or organizations, political activities or organizations, or other group activities or organizations.
(12) Actions that overload ajiwai’s servers beyond the normal use of ajiwai, or actions that encourage such actions, or other actions that attack ajiwai’s website or servers.
(13) Actions that duplicate, modify, reprint, alter, change, reverse engineer, disassemble, decompile, translate, or analyze the functions provided by ajiwai.
(14) Injuring the honor or credit of ajiwai or our company, or infringing on the property rights of ajiwai or ajiwai.
(15) Actions aimed at inducing other users to use services that are identical or similar to ajiwai, or that compete or may compete with ajiwai.
(16) Actions that obstruct or interfere with the operation of ajiwai or the use of ajiwai by other users
(17) Actions that cause significant hindrance to ajiwai’s operations by calling ajiwai for long periods of time, by repeatedly making similar inquiries to ajiwai for excessive periods of time, or by forcing ajiwai to do something for which it has no obligation or reason to do so.
(18) Attempting to access the Company’s services by means other than the interface provided by the Company
(19)acts of one user obtaining multiple user IDs
(20) Acts of transacting or soliciting to transact a cooking experience with a registered user or a person who has been a registered user within the past 5 years, without using our service
(21) Advertising, selling, or commercial activities for products that are not approved by the Company (e.g., selling cooking utensils after the cooking experience is over)
(22) In addition to the above, acts that the Company deems inappropriate.

Article 9 (Acceptance of Reservation by Host and Confirmation of Cooking Experience by Reservation Request)

1. You, as a host, may register a reservation request for a cooking experience with ajiwai. In order to register a reservation request for a cooking experience, the Host will register the following information, which will be displayed on ajiwai’s menu list
(1) Candidate dates and times when the cooking experience can take place (set via Google Calendar)
(2) Location(s) where the cooking experience will take place
(3) A description, image, or other summary of the dish(s) to be served during the cooking experience
(4) Participation fee for the cooking experience (“Participation Fee”).The amount of consumption tax to be paid by the host. If the Host is a taxpayer, the Participation Fee shall include consumption tax and local consumption tax (hereinafter referred to as “Consumption Tax, etc.”).
2 The Host agrees that the following information and other information about the Host held by the Company may be posted on the ajiwai web page and shared with Guests whose reservation requests are approved, in order to provide information necessary for the Guest to make a reservation request for the Cooking Experience.
(1) Self-introductory text
(2) Profile picture
(3) Reviews you have received from guests
(4) Full name
(5) Address(es) where the cooking experience will be held
(6) Phone number
(7) Message function (WhatsApp is basic)
(8) Any other information we propose to post on ajiwai’s web page or share with guests
(9) Details of the experience
3 As a guest, a user may make a reservation request for a cooking experience on the ajiwai website in response to a reservation request for a cooking experience. In this case, the guest agrees that ajiwai may post the guest’s first and last name, self-introductory text, profile picture, and other information about the guest held by ajiwai on the ajiwai web page and share such information with the host who accepted the reservation request for the cooking experience. The host and guest who accepts the reservation request may contact each other to inquire about the cooking experience, and shall respond sincerely to any communication or inquiry they receive.
4 In order to prevent identity theft, it is recommended that the host and guest verify each other’s identity when conducting the cooking experience.

Article 10 (Disclaimer)

1 The Company shall not be liable for any damages caused by changes in the contents, interruption, or termination of the Service.
2 The Company shall not be involved in, and shall not be liable for, the user’s environment for using the Service.
3 The Company makes no warranty that the Service will be suitable for the user’s specific purpose, that it will have the expected functions, commercial value, accuracy, or usefulness, that the user’s use of the Service will conform to the laws and regulations applicable to the user or internal rules of industry associations, or that defects will not occur. 4. We do not guarantee that the Service will be fully compliant with the laws and regulations applicable to users or internal rules of industry associations, etc., or that there will be no defects.
4. The Company does not guarantee that the Service is compatible with all information terminals, and the user acknowledges in advance that malfunctions may occur in the operation of the Service due to OS upgrades, etc. of the information terminal used for use of the Service. The Company does not guarantee that such defects will be resolved by the Company’s modification of the program, etc. in the event of such defects.
5 The Company shall not be liable for any damages incurred by the user directly or indirectly as a result of using the Service.
6 The Company shall not be liable for any loss of opportunity, interruption of business, or any other damages (including indirect damages and lost profits) incurred by users or other third parties, even if the Company has been notified of the possibility of such damages in advance.
7 The provisions of Article 10 shall not apply in the event of intentional or gross negligence on the part of the Company or in the event that the contractor is a consumer under the Consumer Contract Act.
8 Even if the preceding paragraph applies, we shall not be liable to compensate for damages arising from special circumstances among damages incurred by the user due to acts of negligence (excluding gross negligence).
9 In the event that we are liable for damages in connection with the use of this service, we shall be liable for damages up to the amount of usage received from the user in the month in which the relevant damages occurred.
10 We shall not be liable for any disputes and troubles between users and other users. In the event that a dispute arises between a user and another user, both parties shall be responsible for resolving the dispute and shall not make any claim against the Company.
11 In the event that a user causes damage to another user or a dispute arises with a third party in relation to the use of this service, the user shall compensate for such damage or resolve such dispute at the user’s own expense and responsibility, and shall not cause any trouble or damage to the Company.
12 In the event that our company receives a claim for damages, etc. from a third party as a result of the user’s actions, the user shall resolve such claim at the user’s expense (attorney’s fees) and responsibility. In the event that this company pays compensation for damages to said third party, the user shall pay all expenses (including attorney’s fees and lost profits) including said compensation for damages to this company.
13 In the event that a user causes damage to our company in relation to the use of this service, the user shall compensate our company for the damage (including legal fees and attorney’s fees) at the user’s expense and responsibility.
14 When a user receives a request from another user or a third party to delete a posting, the Company may decide whether or not to delete the posting at its discretion, and the Company shall not be held responsible for any and all liability arising from such decision.
15 The Company does not guarantee the accuracy of information posted by other users on the Service. The Company shall not be liable for any disputes or troubles regarding the information posted on the Service.

Article 11 (Posting of Advertisements)

Users understand and agree that the Service may include any and all advertisements, and that the Company or its partners may place any and all advertisements on the Service. The form and scope of advertisements on the Service may be changed by the Company at any time.

Article 12 (Prohibition of Transfer of Rights)

Users shall not transfer their positions under the Terms of Use or their rights or obligations under the Terms of Use, in whole or in part, to any third party without the prior written consent of the Company.

Article 13 (Severability)

Even if any provision of these Terms and Conditions or part thereof is determined to be invalid or unenforceable under the Consumer Contract Act or other laws or regulations, the remaining provisions of these Terms and Conditions and the remainder of any provision that is determined to be invalid or unenforceable in part shall remain in full force and effect.

Article 14 (Method of Contacting Us)

Any contact or inquiry to the Company by a user regarding the Service shall be made by sending a message via the inquiry form provided on the Service or on the website operated by the Company, or by any other method separately designated by the Company.

Article 15 (Governing Law, Court of Jurisdiction)

1 The validity, interpretation, and performance of these Terms of Use shall be governed by and construed in accordance with the laws of Japan.
2 The Tokyo Summary Court or the Tokyo District Court shall be the court of exclusive jurisdiction for all controversies, lawsuits, and other disputes between the Company and users, etc., depending on the amount of the suit.
